Terms of Service

Welcome to the e‑commerce services provided by www.digalla.com (“the Service”).

These Terms constitute a legal agreement between Users and the Site regarding rights and obligations during service use and transactions.

Using the Service constitutes full acceptance of these Terms. If you do not agree, do not use the Service.

1. Parties Definition

• The Site (service provider): operator of www.digalla.com, legally registered and qualified to provide e‑commerce and payment gateway services.

• User (service user): individual or entity using the Site to purchase goods/services, with full legal capacity to comply with Thai laws and these Terms.

2. Service Content

The Site provides product display, order creation, payment settlement, logistics, after‑sales support, and related e‑commerce services. Actual services are subject to on‑site display.

The Site may adjust services and will announce changes accordingly.

3. Transaction Rules

• Product information: displayed accurately and completely; minor discrepancies may occur due to updates or stock changes. Users may confirm with customer service before ordering. The Site is not liable for unintentional errors (excluding intentional misrepresentation).

• Order formation: submission and successful payment constitute a binding transaction agreement. Users may not unilaterally cancel except as allowed in the Refund Policy.

• Price and payment: prices as shown; supported currencies include THB, USD, etc. Users must pay via approved gateways (Omise, 2C2P, PayPal, TrueMoney, Airwallex). Delivery begins after payment confirmation.

• Delivery and inspection: physical goods delivered by authorized couriers. Users must inspect promptly and report issues within 3 business days. Virtual goods delivered immediately after payment.

4. Payment Terms

• Payment security: Users are responsible for safeguarding payment account details (passwords, OTP). Losses due to User negligence are borne by the User. The Site secures payments via encryption.

• Payment anomalies: failed payment, duplicate charge, deduction without order – Users must contact support with proof for resolution (refund, reissue).

• Transaction authenticity: Users warrant all transactions are genuine and not for false transactions, money laundering, or illegal exchange. Violations may result in order cancellation, account suspension, and cooperation with authorities.

• Fees: payment processing fees (credit card, cross‑border) are borne by either party as stated on product or payment pages.

5. Rights and Obligations

(1) Site Rights and Obligations

• Rights: review orders, reject violations, adjust prices/services, suspend/terminate services for breach of Terms or laws.

• Obligations: provide accurate product/service information; protect personal data under PDPA; provide reasonable after‑sales and technical support; assist with payment and logistics issues.

(2) User Rights and Obligations

• Rights: view information, place orders, pay, apply for valid refunds, access/edit personal data, provide suggestions or complaints.

• Obligations: comply with Thai laws and Terms; provide true and accurate information; protect payment accounts; not engage in illegal activities; not maliciously complain or defame the Site.

6. Liability for Breach

• Site breach: liable for actual damages caused by the Site’s fault (defects, misrepresentation, non‑delivery), up to the total order amount.

• User breach: the Site may cancel orders, reject refunds, suspend/terminate services. User shall fully compensate the Site or third parties for losses caused by violation.

7. Dispute Resolution

Any dispute arising from use of the Service shall first be resolved amicably.

If unresolved, either party may submit to the competent court in Bangkok, Thailand, governed by Thai law.

8. Amendment and Termination

• Terms may be updated for legal or business reasons, posted on the homepage, effective 7 days after publication. Continued use constitutes acceptance.

• The Site may terminate services with 30 days’ prior notice. Rights and obligations will be settled according to these Terms.
